Terms of Service
By downloading, installing, or using MotoPath ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and Samantha Sullivan ("we", "us", or "our").
MotoPath is a motorcycle routing and ride companion application that provides route discovery, GPS navigation, weather information, ride tracking, group ride coordination, and achievement tracking for motorcycle riders. The App is available on iOS and Android devices.
You must be at least 18 years of age and hold a valid motorcycle license in your jurisdiction to use MotoPath. By using the App, you represent and warrant that you meet these requirements. The App is not intended for use by minors under 13.
MotoPath offers a free tier and a premium subscription ("MotoPath Pro") with additional features. Subscriptions are available on a monthly or annual basis and are processed through Apple's App Store or Google Play.
MotoPath may offer a 7-day free trial for new subscribers. The free trial provides full access to MotoPath Pro features. After the trial period ends, your subscription will automatically convert to a paid subscription at the applicable rate unless you cancel before the trial ends. Only one free trial is available per Apple ID or Google account. We reserve the right to modify or discontinue the free trial offer at any time.
You agree not to use MotoPath to:
MotoPath requires access to your device's location to provide core functionality including route display, GPS tracking, and nearby route discovery. Location data is processed on your device and is not transmitted to our servers. Background location access is used only during active ride sessions. You may revoke location permissions at any time in your device settings, though this will limit App functionality.
All content, features, and functionality of MotoPath — including but not limited to the App design, code, graphics, logos, and text — are the exclusive property of Samantha Sullivan and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our express written permission.
MotoPath integrates with the following third-party services, each governed by their own terms and privacy policies:

We are not responsible for the practices or content of any third-party services.
MotoPath is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of viruses. Route information, speed limits, and navigation data are provided for informational purposes only and may not be accurate or up to date. We expressly disclaim all implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by applicable law, Samantha Sullivan shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of MotoPath. Our total liability to you for any claims arising from your use of the App shall not exceed the amount you paid for the App or subscription in the 12 months preceding the claim.
These Terms are governed by the laws of Arkansas, USA, without regard to its conflict of law provisions.
Any dispute, claim, or controversy arising from or relating to these Terms or your use of MotoPath shall be resolved by binding individual arbitration in Arkansas, USA. You waive any right to participate in a class action lawsuit or class-wide arbitration. Either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm.
If you downloaded MotoPath from the Apple App Store, the following additional terms apply:
We reserve the right to modify these Terms at any time. We will notify you of material changes through the App or by updating the "Last updated" date above. Your continued use of MotoPath after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using MotoPath.
We reserve the right to suspend or terminate your access to MotoPath at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the App ceases immediately. Provisions of these Terms that by their nature should survive termination will remain in effect.
Your use of MotoPath is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
